U.S. District Judge Alvin Hellerstein died Wednesday morning at age 92, just five months before his 93rd birthday. His death leaves the high-profile drug trafficking case involving former Venezuelan President Nicolas Maduro without a presiding judge. The Southern District of New York confirmed that the trial will now be randomly assigned to a different federal judge in accordance with standard court procedures.

Chief Judge Laura Taylor Swain confirmed the death and described Hellerstein’s tenure as energetic and dedicated. She stated that the judge served the court until his passing and that he will be sorely missed. The court attributed the death to natural causes. Hellerstein had held his seat on the federal bench since 1998, when former President Bill Clinton appointed him.

The judge’s docket included some of the most litigated cases in New York history. Following the September 11 attacks, Hellerstein managed more than 10,000 claims from first responders who suffered illnesses due to exposure to toxic dust at Ground Zero. He also oversaw civil litigation brought by victims’ families and businesses against airlines and airport security firms, with plaintiffs seeking compensation for negligence and property damage.

Beyond the 9/11 litigation, Hellerstein handled the 2009 copyright dispute between the Associated Press and artist Shepard Fairey over the famous Obama "Hope" poster. He also presided over civil suits against film producer Harvey Weinstein, rejecting a proposed $18.9 million settlement in 2020. That same year, the judge ordered former attorney Michael Cohen to be moved from federal prison to home confinement, finding that authorities had retaliated against him for planning to publish a critical book about President Donald Trump.

Maduro and his wife, Cilia Flores, are currently in federal custody following their capture by U.S. forces in an overnight mission in early January. Both were indicted during the first Trump administration, and the Department of Justice offered a $50 million reward for information leading to their arrest. Maduro faces charges of narco-terrorism conspiracy, cocaine importation, and weapons offenses. He and Flores have pleaded not guilty to all counts.

The trial was originally scheduled to begin on June 1, 2027. With Hellerstein’s passing, the case will be transferred to a new judge, who will determine the next steps in the proceedings. The court spokesperson, Ed Friedland, confirmed that the reassignment process follows established legal protocols for vacant judicial seats.
