Luhansk Court Compels Russia to Pay $1.6 Million for Sunflower Seeds Lost in Occupation

A commercial court has ruled that Russia must compensate a Lviv based firm for crop destroyed in Svatove, marking a significant financial judgment against the state.

A commercial court in Luhansk Oblast has issued a ruling requiring Russia to pay 65.36 million hryvnia, or approximately 1.6 million US dollars, to a private company that lost a significant stock of sunflower seeds during the occupation of Svatove.

The decision, which comes from the court's official documentation, establishes a direct financial liability on the Russian state for agricultural assets destroyed in the region. The compensation is intended to reimburse Oliiar, a firm registered in Pustomyty in Lviv Oblast, for the specific value of the crops that were never recovered after the conflict began.

The origins of the dispute trace back to October 2021, when Oliiar entered into an agreement to purchase 4,700 tonnes of sunflower seeds from the 2021 harvest. The seller in this transaction was Prydniprovske Agrarian Company LLC. To manage the logistics of the purchase, Oliiar arranged for the crop to be held at a storage facility operated by Svatove-Ahro LLC in Svatove.

The supplier successfully delivered the entire consignment to the designated warehouse. By the time the full scale invasion commenced on February 24, 2022, the facility had already transferred 2,592 tonnes to Oliiar. This left a remainder of 2,107 tonnes still stored on the premises, which would later become the subject of the legal claim.

Following the start of the full scale invasion, Russian armed groups seized control of the warehouse premises where the remaining seeds were located. Oliiar was unable to retrieve that portion of its purchase, resulting in a total loss of the stored inventory. The company has since pursued legal action to recover the value of the missing goods.

In its final decision, the court determined that Oliiar provided conclusive evidence linking the loss of the crop directly to the armed aggression conducted by Russia. Based on this finding, the court ordered the Russian state, which is represented in the proceedings by the Russian Ministry of Justice, to provide the specified compensation. The final figure of 65.36 million hryvnia was established through an expert valuation of the lost assets.

The company at the center of this case is led by Iryna Podoba, who serves as the director, while Iryna Zalizna is listed as the founder. The ruling highlights the ongoing efforts by Ukrainian businesses to recover financial losses incurred due to the occupation of their territories and the destruction of their commercial property.

This judgment follows a similar precedent set by the same court earlier in its proceedings. In a previous decision, the court ordered Russia to pay 51.67 million hryvnia, equivalent to roughly 1.25 million US dollars, to Trading House Agrokhim LLC. That earlier case involved property lost in Svatove in Luhansk Oblast and in Kakhovka in Kherson Oblast. These consecutive rulings underscore the legal framework being applied to state liability for wartime damages.

The next steps involve the enforcement of this court order, a process that often presents challenges in the context of an ongoing international conflict. The ruling serves as a formal acknowledgment of the financial impact of the war on private enterprise in occupied regions, providing a legal basis for further claims by other affected businesses.
